Van Weyenbergh Fine
Arts Inc. agrees to provide appraisal, expertise, or
authentication services concerned specified items of personal
property for the Client and subsequently to provide the Client
with a report to include the original copies of any and all
obtainable authentication, appraisal, expertise documents,
including written expertise provided by the recognized expert in
field, if applicable, where one such individual exists. It
is understood by both parties to this agreement that the purpose
of this assignment is to determine whether the item (s)
presented are demonstrably authentic, or alternatively
facsimiles of an original or a particular maker’s style, whether
or not they may be deemed to have been purely as BONA FIDE
copies or with deliberate intent to deceive. Where Van
Weyenbergh Fine Arts Inc., on the advice of recognized experts,
determines a work not to be an authentic example of the work of
a specific maker, school or period of manufacture, the submitted
report and his findings shall only constitute an informed
professional opinion and Van Weyenbergh Fine Arts Inc. makes no
claims as to the infallibility of that opinion. The Client
therefore expressly waives any right to make claims against Van
Weyenbergh Fine Arts Inc. or its agents concerning the ultimate
validity of that opinion or its ability to withstand refutation
by any other party.
The Client agrees to compensate Van
Weyenbergh Fine Arts Inc. for this service at the rate
, US$ for each work of art or antique for which
documentation is sought.
The Client agrees to make payment
for this service upon the signing and submission of this
agreement. Any expertise and documentation will not be released
to the client without payment of final bill invoices, the total
fee should not exceed US$ .
Where fees are demanded by experts for the issuance of a
photo-certificate, if applicable, Van Weyenbergh Fine Arts Inc.
will apprise the Client prior to commitment, if disposed to pay
the requisite fee for the expert, the Client agrees to make
payment in full in advance to Van Weyenbergh Fine Arts Inc. to
cover such fees.
It is also agreed that any controversy or
claim arising out or relating to this contract or the breach
thereof, shall be settled by arbitration in accordance with the
commercial arbitration rules of the American Arbitration
Association and judgment upon the award rendered by the
Arbitrator (s) may be entered in any Court having jurisdiction.
The Client hereby authorizes Van Weyenbergh Fine Arts Inc., to
execute a formal report on his/her behalf in accordance with the
tenets of this contract and the Conditions and terms on the
reverse which she/he has read, understood, and agrees are
reasonable.
The total cost of this authentication, appraisal,
expertise, will not exceed US $ , unless an agreement between
Van Weyenbergh Fine Arts Inc, and the Client.
Travel expenses
not included will depend on necessity to analyze the painting
itself, and the opportunity to combine travel with other client
in the same area.
